Lawyer’s Defense to Meth Charge: ‘I Did it for My Dog’— Wins Acquittal

Truth, as they say, is stranger than fiction, and the prosecution of Indiana lawyer Brad Happe, 30, on conspiracy to manufacture methamphetamine charges is clearly no exception.

The case began March 29 when police allegedly confiscated ingredients commonly associated with manufacturing methamphetamine from Happe’s law office and apartment.

Prosecutors alleged Happe—who admits to using drugs—had an agreement with a police informant to manufacture methamphetamine and that he procured the necessary ingredients, included ephedrine powder from cold pills, sulfuric acid, ether and a tank of anhydrous ammonia.

Hmmm, certainly sounds like compelling evidence, right?

But the methamphetamine using lawyer was acquitted. His defense: “I did it for my dog”.

Happe testified in his own defense, saying he went along with the informant’s suggestions because he believed the informant would help him get back his dog, a Shih Tzu mix named Mr. Cole. The informant had testified a woman had taken the dog because she believed Happe had taken a tank of anhydrous ammonia from her.

“I had hope he would come through with my dog,” Happe said. “When I was coming down on meth, I was not thinking clearly. With that, I was handicapped. The choices I made were not clear.”

Happe admitted he was an addict — in 2006 he pleaded guilty to a misdemeanor charge of visiting a common nuisance — and that if anything good had come out of his arrest it was that he was getting help.

Happe’s attorney, John Brinson, said in closing arguments that police targeted Happe because he was a defense attorney and a drug user. He said Happe deserved the same second chance that the informant had received for cooperating with police.

In summary: 1. I did it for my dog; 2. I was high and 3. Give me the same immunity the informant who testified against me got. And it worked!

Wait... Let me get this straight. Happe - a defense attorney - (dear God I hope now FORMER defense attorney) is claiming through his lawyer that he was 'handicapped' because he was coming down off of his drug use, and therefore shouldn't be found guilty.

Let us hope that the prosecution was simply asleep and failed to make an objection to any comment that self-imposed intoxication is a defense. Further, if he hasn't been already, Happe really, really needs to be disbarred.
