Mel Gibson's Russian ex-mistress shows what a serious musical talent she is by posing for cover art in her underwearA smoking gun has surfaced in the extortion investigation of Gibson’s former Russian mistress in the form of an email she sent her former attorney Eric George after George negotiated a $15 million payday for the Russian in exchange for the infamous (and we now know, doctored) audio tapes never seeing the light of day.
George also negotiated an agreed custody order eventually giving the actor shared custody of his child.
In a June email leaked to TMZ, the Russian explains her strategy to demand an even greater cash payout from Gibson and to “renegotiate” the custody agreement by upping the ante with domestic violence allegations.
The Russian said:
"If the opposition is buying my silence, please, we have to renegotiate the custody portion and to secure the monetory (sic)."Oksana also reiterated that Gibson “doesn't want this publicity", and concluded the email by stating “I’m not bluffing.”
This email is significant on a number of levels.
It shows she perjured herself when she testified that she did not understand that she had entered into a joint custody agreement at the June mediation. It shows that the mediated agreement was not simply a “proposal” (as she also testified) but an inked deal. And it shows not only her avarice but admits that she knew she was seeking millions from Gibson so she would not reveal career damaging secrets to the media—which is the essence of extortion.
According to TMZ, Law enforcement sources say this email is part of the L.A. County Sheriff's Department's extortion investigation, to determine if Oksana used the tapes to score the $15 million package. The theory: After signing the agreement, Oksana got greedy and decided she could get more by adding a fresh domestic violence claim.

According to TMZ, this morning, the dirty russian whore refused to turn the baby over to Mel’s nanny for his court ordered overnight visitation with his daughter Lucia. Her excuse, of course, is that earlier in the week, Mel didn’t return the baby on time; so, she was entitled to “make-good” for the earlier slight. Mel should have called the cops! For the love of god, the dirty russian whore continues to act as if the CUSTODY FIGHT is taking place on the playground during the third graders recess. It’ll be interesting to see what happens Monday morning when Mel goes to court and asks the judge to strip her of custody and overnight visits, and only allow supervised daytime visits.
Although attorneys 2-42 advised her not to do it, on November 3, the Russian waived her attorney-client privilege regarding her 1st attorney Eric George. So, will Judge Gordon allow George to meet with the LASO and answer those nagging questions regarding her attempted extortion, photoshoped pics, edited tapes, leaked tapes? God, I hope so!
Attorney-client privilege is considered on a communication-by-communication basis, so it depends which communications with George she waived the privilege to.
Clearly, the Russian thinks she has a equal entitlment to Gibson's millions as his ex-wife, loves to be in the limelight, and is dumber than wood.
She is headed over a legal cliff.
She won't lose custody though unless she goes to jail, and even then only temporarily.
Mothers lose custody for being found unconscious from booze or drugs with the 3 year old found unattended on the front lawn or in the bathtub, and not because mom is a dumb you-know-what who only views the kid a a meal ticket.
She was bound and determined to live in Malibu -- even though Mr. Gibson told her to get out -- Mr. Gibson's family told her to get out -- and nobody wants to be around her.

Using your kids might be allowable as 'tough negotiating' but threatening careers and publicity is extortion.

So in order to prove she committed extortion they have to prove she used the recordings to secure the $15 mil? What if they cannot prove that? Evidently everyone involved called the "tapes" the "elephant in the room". Is the email regarding using DV to get more money enough to charge her with attempted extortion? Or, is there a charge for "gaming the system" in family court - you know, using DV to get full custody and more money?

The California law relating to the crime of extortion is as follows:
“Extortion is the obtaining of property from another, with his
consent, or the obtaining of an official act of a public officer,
induced by a wrongful use of force or fear, or under color of
official right. (Penal Code sec. 518.)
“Fear, such as will constitute extortion, may be induced by a
threat, either:
1. To do an unlawful injury to the person or property of the
individual threatened or of a third person; or,
2. To accuse the individual threatened, or any relative of his, or
member of his family, of any crime; or,
3. To expose, or to impute to him or them any deformity, disgrace
or crime; or,
4. To expose any secret affecting him or them.” (Penal Code sec. 519.)
“Every person who extorts any money or other property from
another, under circumstances not amounting to robbery or carjacking,
by means of force, or any threat, such as is mentioned in Section
519, shall be punished by imprisonment in the state prison for two,
three or four years.” (Penal Code sec. 520.)
Therefore, the key to charging Gibson’s ex with extortion would be Los Angeles County prosecutors determining that admissible evidence exists that is likely to persuade a jury beyond a reasonable doubt that the ex-coupled a demand for money or property with a conditional threat to accuse Gibson of a crime and/or expose a secret about him the public or the media.
The case does not necessarily have to be about the tapes.

According to Radar Online and the New York Post, the DA intends to file charges against Mel for domestic violence. Given the bat-shit-crazy behavior of the dirty russian whore, what are the odds he'll be found guilty?
Since Mel admits he "slapped" the Russian albiet to rescue his infant daughter from an out-of-control mom--one can see how the case might be filed.
Convicted, though?

The person who knows more about Oksana Grigorieva's claims against Mel Gibson than anyone tells TMZ ... Oksana is grossly exaggerating or downright lying about the alleged domestic violence incident.
Kristian Herzog -- who served as Oksana's bodyguard until recently -- tells TMZ, Oksana admitted to him Mel never punched her, as she claimed to authorities. Rather, Herzog says Oksana told him Mel slapped her, and that's it. As TMZ first reported, Mel admitted slapping Oksana because he says she was shaking baby Lucia wildly.
Herzog -- who has been subpoenaed by Mel's lawyers in the custody war -- tells us Oksana admitted to him that she secretly taped Mel Gibson "to pressure Mel to pay her money." Oksana is currently being investigated by the L.A. County Sheriff's Department for alleged extortion.
Herzog -- who was privy to virtually every conversation Oksana had with her lawyers -- claims he had a sexual relationship with Oksana -- she denies it.
Herzog -- who runs The Bodyguard Group of Beverly Hills -- calls Oksana a "sexual sorceress."
Oksana's lawyer, Dan Horowitz, had no comment.
i have followed your blog since the beginning of this whole fiasco. Thank you so much for letting us know from the legal points of view regarding this ordeal that she devil has created not only for Mel and his family but for all of us law abiding citizens of this country.
it is a shame that the DA and the police has to take into consideration other aspects of this case and not just the law. what i mean is that they seem to be hesitating with their charges of this she devil as not to anger those who may be angry at Mel. i hope the DA and the police do follow the law and arrest the she devil who seemed to have clearly broken the law trying to extort more money using Lucia.
through your blog it seems so clear that she had committed extortion and how about the fact that she also broke the law on taping the phone conversation? she was obviously not in fear for her life since she simply turned all the phones off, took the batteries out and slept instead of leaving the house or calling the police...she should be charged with felonies counts on all the tapings she has done. why has she not been charged with anything?

i have another question...from the beginning the judge has ordered the gag order to both parties and we all know that Oxi has not been able to keep her mouth shut from the beginning until recently. but the damage has been done and she also gave People Mag and Larry King interviews...all that the judge has done is to keep warning her it appears with no sanctions. it seems the judge gave this gold digger many chances without any repercussion for her lies to the public. what do you feel about this as far as why the judge has not done anything except to keep giving her warnings...it is very frustrating that Mel has been silent and following the judge's orders while the she devil can continue to speak without any consequences. this investigation seems to take a long time, longer than expected for may of us who have been following this case. it seems the police and the DA are reluctant to charge anyone with anything and perhaps let things go as is in the family court. i fear if the she devil is not charged and convicted, she will continue to use Lucia against Mel for the next 17 years. Mel will need to continue to defend himself from the she devil with any fabricated charges she will bring.
possibly if this she devil is not nipped in the bud so to speak, she may charge Mel with abuse of Lucia at some point..look what she has said already regarding Mel needing to beat her during sex? it is completely outrageous what she can say and do without any consequence from the law.

The L.A. County Sheriff's Department is going into court this AM ... asking the judge in the Mel Gibson/Oksana Grigorieva custody war to turn over court files to see if Oksana has told conflicting stories about alleged domestic violence ... TMZ has learned.
Lawyers for the Sheriff's Dept. just arrived in court. They're asking for a copy of the court file to evaluate the domestic violence case ... but we're told the real focus is everything Oksana has said about events surrounding the blowout on January 6, 2010. We're told investigators want to look at Oksana's declaration and deposition testimony in particular, to determine if she's changed her story.
Based on documents previously reviewed by TMZ and various other information, investigators will find inconsistencies.
We're told the latest request could have a bearing on whether domestic violence charges are filed against Mel and whether the D.A. will file extortion charges against Oksana.
UPDATE: Sources say Judge Scott Gordon just approved the Sheriff's request for the documents.

Well, Blogo, you were right! The dirty russian whore should have taken Mad Mel's $15 million when she had the chance. Wednesday, a judge awarded her just $750.000--and that's to be doled out over the next 5 years. Let's see: 42 attorneys/$750,000--that's about $18,000 to each attorney. Or is each attorney entitled to one-third of her award? Geez, then each attorney would be entitled to $250,000 x 42 attorneys--well, that's only $10.5 million.
Oh, and as of today, Mad Mel has 50/50 legal and physical custody of his 2-year-old daughter--under the $15 million deal she turned down, Mel wasn't going to get 50/50 custody until the baby turned 3.
While the judge told each party he/she can't record or release tapes of the other AND neither can write about the other, the wise judge also told them neither can hire a 3rd party to record or write about the other. (And the judge pointedly told her if she violates his order, Mel doesn't have to pay her the remainder of the $750,000!) Finally, the dirty russian whore's gravy train has ended. But don't worry about the russian whore, according to her attorney, she's got 2 new recodings coming out in the next year.
